Delaware man gets seven years for 2009 shooting

A Delaware man pleaded guilty to first-degree assault Monday in connection with a 2009 shooting at the Perryville Motel that wounded an Aberdeen man.

In exchange for his guilty plea the state dismissed six additional counts of the indictment against Joevany Teodoro Luna, 36, of the 1000 block of Tenth Street in Wilmington, Del.

As part of the binding plea deal, Luna received a sentence of seven years with the state department of corrections. Luna was also credited with 598 days served based on time spent in jail awaiting adjudication of the case.

In October 2009, Luna shot Stefvin Darrell Ross, then 20, one time in the abdomen while Ross was in his motel room at the Perryville Motel.

Ross, who had an address in Aberdeen, was flown by Medevac helicopter to Maryland Shock Trauma Center in Baltimore and has since recovered from his wounds.

Police at the time said the shooting was drug related.

When police arrested Luna at a house in Newark, Del., later that month, they allegedly found a loaded handgun next to his bed and other firearms inside the house.

Assistant State's Attorney Perry Seaman said Thursday a resolution of the case seemed the best option for all involved based on several factors.

"The victim was uncooperative and there was a pending federal case," Seaman said.

While the pending federal case is not related to the Cecil County case, the local case needed to be resolved before the U.S. District Attorney's Office in Wilmington, Del. could move forward, Seaman explained.

A federal prosecutor reached out to Seaman and asked him if he could resolve the state case.

"This had to be resolved so they could proceed," Seaman said.

The request, paired with the victim's lack of cooperation and the understanding that Luna will likely receive more jail time for the federal charges, lead to the plea deal that Luna ultimately accepted Monday.

Seaman said he expects Luna to face the federal charges within 30 days.
