Delaware man convicted in 2009 Perryville shooting sentenced to more jail time in federal case

A Delaware man who pleaded guilty to a 2009 shooting at the Perryville Motel was sentenced Wednesday to more jail time in connection with a federal case.

Joevany Teodoro Luna, 36, of the 1000 block of Tenth Street in Wilmington, Del., was sentenced to serve 77 months in prison for being in illegal possession of a loaded firearm. Luna was sentenced by U.S. District Court by Chief Judge Gregory Sleet after previously pleading guilty to the charges.

The gun charges stemmed from his arrest in the 2009 shooting case.

In October 2009, Luna shot Stefvin Darrell Ross, then 20, one time in the abdomen while Ross was in his own motel room at the Perryville Motel.

Ross, who had an address in Aberdeen, was flow by medevac helicopter to Maryland Shock Trauma Center in Baltimore and has since recovered.

Police said at the time the shooting was drug related.

When police arrested Luna at a house in Newark, Del., later that month, they found a loaded handgun next to his bed and other firearms inside the house. The firearm, which was found within arms reach of Luna, was a different make and model than the one used in the Perryville shooting, according to a release from the U.S. State's Attorneys Office for the District of Delaware.

In June, Luna pleaded guilty in Cecil County Circuit Court to first-degree assault and in exchange, the state dismissed six additional counts of the indictment.

An assistant state's attorney said at the time of the plea that the victim was not cooperative and the District of Delaware could not move forward on the weapons case until the shooting case was resolved. All of these factors went into the binding plea deal which involved a seven year jail sentence with a 598 day credit based on time spent in jail awaiting trial.

On Wednesday, Sleet imposed a sentence of 97 months, which is eight years and one month, in connection with the weapons charge.
