Man in brawl will not be prosecuted

A man whose leg was broken during a fight in which a uniformed police officer shot and killed an off-duty officer was released without charges yesterday, authorities said.

The man was initially charged with disobeying police, according to a source familiar with the investigation who was not authorized to talk about the charges. The state's attorney's office declined to prosecute, said Margaret Burns, a spokeswoman for city State's Attorney Patricia C. Jessamy.

The man's name has not been made public.
