A Baltimore County jury found two men, including a former Baltimore County police officer, not guilty yesterday on charges of raping a woman at the former officer's apartment.

Kyle Alexander Wilson, 29, of the 5200 block of Stone Shop Circle in Owings Mills and Frank Sung Ha, 24, of the 4700 block of Mercury Drive in Rockville were accused of raping the 20-year-old woman in Wilson's apartment on Aug. 4.

Police said the two men and two women were drinking alcohol at Wilson's apartment early that morning. Later that morning, police said, Ha raped one of the women while Wilson drove the other woman home, then Wilson returned home and allegedly raped the woman.

Wilson and Ha were accused of second-degree rape, fourth-degree sex offense and second-degree assault.

Wilson was suspended from the county police force without pay in August after he was accused of the rape and was fired in October.

Wilson's future as a police officer was unclear last night.

"If he reapplies, then the department will look at all issues," said Cpl. Vickie Warehime, a county police spokeswoman.

In closing arguments yesterday, John Cox, assistant state's attorney, told the Circuit Court jury that the woman -- whose name is not being published by The Sun because of the nature of the allegation -- had injuries showing she resisted intercourse.

Kimberly Ann Alley, Wilson's attorney, argued that such injuries could result from consensual or nonconsensual sex and that no physical evidence proved a rape occurred.
