W.Va. man gets probation, fine for drug distribution


A 20-year-old West Virginia man was given a five-year suspended sentence in Carroll County Circuit Court yesterday for trying to sell a pound of marijuana to an undercover trooper in a Mount Airy shopping center in August.

Jason Wayne McGilton of Harpers Ferry was also ordered to serve two years of supervised probation and pay a $2,500 fine. Circuit Judge Luke K. Burns Jr. suspended all but $500 of the fine yesterday.

McGilton, who works as a carpenter in Mount Airy, was convicted of marijuana distribution in December after he agreed to allow a prosecutor's statement of facts to be the only evidence presented against him. In exchange, prosecutors dropped possession charges against McGilton.

According to police, McGilton tried to sell Tfc. Robert Heuisler a pound of marijuana in the parking lot of the Ridgeside Business Center in the early morning hours of Aug. 8. Police said McGilton had driven to Rockville for the drugs, which he offered to Trooper Heuisler for $2,500.
