Parents sue driver who killed son $4 million sought in Jan. 8 accident

The parents of a Rockville man killed in a drunken driving accident last January filed a $4 million suit in Circuit Court yesterday against the Crofton motorist who hit him.

Melvin and Eve Getz allege that negligent driving by Michael T. Bardowski, of the 1800 block of Sharwood Place, killed their son, Greg Ian Getz, Jan. 8.

According to the suit, Mr. Getz, 28, was killed about 11:30 p.m. when he was hit while standing in the middle of Route 424, near its intersection with Farrell Street. He was exchanging license information after a fender-bender traffic accident.

Bardowski, 40, was convicted Sept. 7 in Circuit Court of homicide while intoxicated.

At trial, evidence showed that he drank a Manhattan cocktail before dinner, shared a carafe of wine with his girlfriend at dinner and had 1 1/2 beers after dinner.

He had a blood-alcohol content of 0.19. Sleet was falling as he came upon the accident scene, which partially blocked the roadway, according to the evidence.

Bardowski could get up to five years in prison when he is sentenced Monday by Judge Raymond Thieme Jr.

His attorney, T. Joseph Touhey, said that the victim may have contributed to the accident because he was standing in the middle of a darkened roadway when he was hit.
