Former state health official John M. Staubitz Jr. is expected to ask a Circuit Court judge tomorrow to review the $500,000 bail set by a District Court judge, according to court papers.
Mr. Staubitz, 45, is being held in the Carroll County Detention Center on 17 charges related to four house break-ins last month. Police say he and Robert E. Emmons Jr., 29, burglarized 12 homes in Carroll, Baltimore and Howard counties over a period of several weeks.
Carroll prosecutors had asked District Judge Donald M. Smith to revoke the $100,000 bail that was set for each of the two men shortly after their Sept. 24 arrest. Judge Smith, in a hearing Oct. 1, instead raised the bail to $500,000, a sum Mr. Staubitz has said he can't raise.
In a request for a hearing filed in Circuit Court last week, Mr. Staubitz called the bail amount "excessive and in violation" of his constitutional rights. Mr. Emmons had not filed a similar hearing request.
