Tavern must shield premises before expanding storage area

The owners of a Pasadena tavern must shield neighboring residents from its customers and operations before expanding a storage area at the rear of the bar.

An administrative hearing officer has granted Harry Paesch and Darlene Fratantuono permission to build a 647-square-foot addition on the back of the Magothy Inn, a 45-year-old fixture in the Chelsea Beach community.

First, however, hearing officer Robert Wilcox ordered the owners to plant evergreen trees, at least 4 feet tall, between the bar, its neighbors to the east and Center Drive.

He directed the owners to construct a 6-foot privacy fence along the entire west side of the property by Jan. 30 to shield neighbors from its parking lot.

Mr. Wilcox restricted the business hours from 11 a.m. to midnight through Thursday, 2 a.m. on Friday and Saturday, and 10 p.m. on Sunday.

During a Nov. 5 hearing, neighbors complained about loud music and noise coming from the bar late at night and about traffic.

Although the property is residentially zoned, it has been ruled a permitted non-conforming use since 1980. A special zoning exception is required to expand a non-conforming use.

"Regretably, the tavern by its nature is incompatible with a residential area, [but] this office has no authority to abate that use," Mr. Wilcox said in a Nov. 18 decision.
