Dustin Michael Knode, 23, of the 500 block of Chestnut Court, was placed on 18 months of supervised probation.

Taneytown police responded to Knode's residence around 6 p.m. Dec. 6 for a report of an assault and met with Knode, who appeared intoxicated, according to the statement of facts read into the record by Assistant State's Attorney Brenda Harkavy.

The victim told police she and Knode were in an argument and he began choking her with enough force to cause her to have trouble breathing, according to Harkavy.

Public defender Diane Lach said Knode has been attending an abuser intervention program as well as a substance abuse counseling program since the incident and wants to continue with his recovery.

Harkavy said the state did not oppose probation before judgment because Knode did not have a criminal record but requested supervised probation because of the severity of the incident.

In addition to continuing abuser intervention and substance abuse treatment, Galloway ordered Knode to have no unlawful contact with the victim and to enroll in a GED program.
