A Hampstead man who entered a plea agreement for sexual abuse of a minor Tuesday will be sentenced in January after he submits to mental health evaluations as ordered by the court.
Alan Lee Gianni Isner, 25, of the 1700 block of Broadbeck Road, pleaded not guilty but agreed not to challenge the state's version of the facts as a part of the plea agreement.
The state will request 20 years in prison with all but seven years suspended at sentencing, according to Senior Assistant State's Attorney Kelley Galvin. Judge J. Barry Hughes agreed to sentence Isner to no more than seven years of active incarceration.
Isner has been held at the Carroll County Detention Center on $200,000 bond since his arrest, according to electronic court files.
Isner abused a child between 2008 and 2013 beginning when the victim was 8 years old, according to the statement of facts read by Galvin.
The case was referred to the Carroll County Advocacy and Investigation Center in January, and the victim was interviewed by a detective, according to Galvin.
The victim described at least two instances in which he was alone with Isner and Isner touched him inappropriately, according to Galvin. Isner also threatened the victim and told him not to tell anyone, Galvin said.
When he was interviewed, Isner admitted to touching the victim inappropriately and said that he would submit to the necessary punishment, according to Galvin.
Isner also said that he did not consider himself a pedophile but that his actions made him feel like one, Galvin said.
Public defender Lee McNulty said he would have argued that some of the state's details were incorrect if the case had gone to trial, including the number of incidents, but said the remaining facts still supported the charge of sexual abuse of a minor.
After Hughes found Isner guilty, per the plea agreement, McNulty said his client had just informed him that he did not want to submit to evaluations prior to sentencing.
As a part of the plea agreement, Isner must be evaluated by the Department of Health and Mental Hygiene and submit to a presentencing investigation (PSI), according to Galvin.
Hughes told Isner that he could consider the plea agreement void if Isner refused evaluation and issued court orders for a DHMH evaluation and a PSI.
Sentencing was scheduled for Jan. 28 in the Circuit Court for Carroll County, according to Hughes.
