A North Carolina man remains in “serious condition” at the University of Maryland Shock Trauma Center after being struck by a driver on Maryland-140 East early Saturday morning, police said Monday.

Michael Scott Waggy, 39, of Sparta, North Carolina, was walking in the center of a lane on Baltimore Boulevard around 3:58 a.m. Saturday in diminished visibility because of rain conditions, Maryland State Police said.

David Alan Martin, 32, of the 6600 block of Monroe Avenue, was charged with one count each of first-degree assault, second-degree assault and reckless endangerment.

The driver of a Hyundai, a man from Taneytown who has not been cited in the incident, was traveling east on Baltimore Boulevard near Gorsuch Road and was unable to avoid striking Waggy, who was “walking in the same direction and directly in the path of” the vehicle, police said.

The road was partially closed for about two hours.
