Pagans Motorcycle Club President Named in New Maryland Indictment

David Keith Barbeito of Myersville was already in a lot of trouble when, on May 27, he landed in more. That's when a federal grand jury in Maryland indicted him for possessing a Colt .45 semiautomatic pistol with an obliterated serial number and a Streetsweeper 12-gauge shotgun not registered to him. The new charges were brought almost eight months after Barbeito, the national president of the Pagans Motorcycle Club, was charged in West Virginia under a federal racketeering indictment that named 55 members of the club as defendants. The new Maryland charges resulted from the Oct. 6, 2009,

The raid turned up 18 firearms, including the two for which he is now being charged, along with nearly 2,000 rounds of ammunition, three bullet-proof vests, a host of Pagans-related paraphernalia and records, and $12,650 in cash. In the sprawling racketeering case in West Virginia, which involves allegations of violence and running a gambling enterprise going back many years, progress toward a trial in Charleston has been hampered by a multitude of legal entanglements over issues in the case. A May 28 letter from Maryland assistant U.S. attorney Andrea L. Smith to Maryland U.S. District Court Judge William D. Quarles, Jr., explains how the government expects the Maryland and West Virginia cases against Barbeito will be resolved.

"It is anticipated," Smith wrote, "that the Maryland charges will be transferred to West Virginia as part of a plea agreement between Mr. Barbeito and the [U.S. Attorney's Office] in Charleston. Having stated that, I cannot represent to this Court that the terms of that agreement have been finalized. I will notify the Court as soon as I know the status of the proceedings against Mr. Barbeito in West Virginia, and whether we will be transferring these charges there, or waiting to bring Mr. Barbeito here for proceedings."
