A company that sells pumpkin-carving kits has dropped its patent-infringement lawsuit against Martha Stewart Living Omnimedia Inc.
According to documents made public on Monday, attorneys for Denver-based Pumpkin Masters Inc. moved to dismiss the case Thursday, a day after it was filed in U.S. District Court.
"It's an ongoing matter, and I can't comment," said Holland & Hart attorney Brian Kinnear, representing Pumpkin Masters.
Cindy Leggett-Flynn, a New York City-based publicist for Martha Stewart Living, declined to comment.
The lawsuit had claimed that Martha Stewart Living was marketing and selling pumpkin-carving kits that violated its patent. Pumpkin Masters was seeking unspecified damages.
Kent Krausman, a Pumpkin Masters executive, insisted last week that the lawsuit, brought a week before Halloween, wasn't initiated to attract publicity.
The lawsuit against Stewart was the latest of several Pumpkin Masters has filed around Halloween, when various pumpkin-decoration kits hit the market.
Past defendants have included Kmart Corp. and Kraft General Foods Inc.
Pumpkin Masters started as a family business in 1986. Founder and former president Kea Bardeen filed a patent for the pumpkin-carving kit in 1987. The kits include patterns and tools.
