Jon Gosselin, TLC in Maryland court today

Kate Gosselin appears on Barbara Walters "10 Most Fascinating People of 2009" last night, and Jon Gosselin is scheduled to be in a Maryland courtroom today fighting back against TLC, the cable channel owned by Discovery Communications of Silver Spring.

TLC is suing Gosselin for breach of contract for appearing on shows other than "Jon & Kate Plus 8," which ceased production last month. The controversial reality TV show ended because Jon Gosselin pulled his eight children off the show even though estranged wife Kate wanted to continue.

TLC is playing down and dirty hardball with Jon Gosselin, who is countersuing TLC. The goal of TLC's suit, of course, is to try and bring Jon Gosselin to heel so he relents and lets TLC have access to filming his children again. Gosselin told Larry King he took them off the air because he came to see that being on reality TV was bad for them. He called it an "epiphany."

Gosselin's attorney says TLC has no claim to exclusivity with his client since the show is off the air. The original argument by Gosselin's attorney was that the contract TLC first signed Gosselin and his family to was unduly restrictive, complicated and unfair.
