Police say fatal shooting of customer at Don's Guns was justified

ShootingsDon Davis

Police now say a clerk was justified in killing a customer who opened fire inside Don’s Guns and Galleries, Inc. on the west side earlier this week.

Store owner Don Davis says Monday's shooting happened in a flash, when 26-year-old Brian Wayner fired three shots at store clerk Ben Chance.
Thursday, Davis showed Fox59 the bullet holes in the walls of his store, as well as the bullet that hit his employee.  Chance fired back at the customer, killing Wayner on the scene.

Davis says Chance reacted exactly how he was trained to.

“He's an instructor and he did exactly what we instruct people to do,” said Davis. “The round that goes through you doesn't kill you. You're still allowed to reach in your pocket and kill whoever did it. And that's exactly what happened in this instance.”
Chance was critically wounded, but is expected to make a full recovery. He could be released from the hospital as soon as Friday.
Davis says he will have a job at Don's Guns for the rest of his life if he wants it.
Meanwhile, investigators are still trying to figure out a motive behind the shooting.
