Fox59 has learned that Ben Chance will undergo another surgery Thursday. His family said Chance is dealing with complications from an infection from the bullet and will have to spend up to another week in the hospital to recover.

On Monday, prosecutors announced that Chance would not face charges related to the shooting, saying that the clerk acted in self-defense.

On Monday, Sept. 17, Chance was working at the store located at 3807 Lafayette Rd. when Brian Wayner, 26, rented a gun and shot three boxes worth of ammunition. According to storeowner Don Davis, Wayner shot Chance twice when he came to the register to check out.

Chance fired back, killing Wayner.

Eyewitness accounts and surveillance footage support that account, prosecutors said.
