An Indiana family is shocked that the person accused in a boating accident that killed a grandmother and grandson, isn't facing more charges.

The two died last summer on Lake Monroe. Police say the driver of the other boat, Winston Wood, had marijuana in his system at the time but he's not being charged with operating a motor craft while intoxicated. The Monroe County Chief Deputy Prosecutor says there is not enough evidence under the current law to support the charges.

Wood is facing charges for leaving the scene of an accident causing serious injury. The victim's family has contact local lawmakers in hopes of changing the law.
