COMMACK, N.Y. - It was a bloody, midday murder in a restaurant parking lot just off busy Jericho Turnpike in Commack, on October 20th, when 44-year-old family man James DiMartino was shot in the head and killed.

Nearly a month after his death, his business partner, 37-year-old Ronald Thornton was arrested Monday, along with two others. DiMartino's grieving widow, now raising 4 children on her own, was not ready to speak about the recent developments.

"No comment," she told reporters from the front door of the family's Nesconset residence.

Police say Thorton set up Dimartino, hiring his stripper friend 19 year-old Monique Randall, and her boyfriend 20 year-old Donovan Raysor, to rob the mortgage lawyer.

"Who was likely to be in a possession of a substantial sum of money," said Suffolk County Lt. Jack Fitzpatrick.

Police say Dimartino thought he was meeting Thornton to discuss business, but wouldn't say who pulled the trigger. All three suspects are being charged with second degree murder.

"The intent (was) to rob him, but at some point he (was) shot and killed and that's what constitutes felony murder," said Fitzpatrick.

DiMartino, a real estate attorney, worked for a number of mortgage companies over the past few years. He got to know Thornton, a mortgage broker from the business deals they closed on.

Police say Thorton and DiMartino had an office in Hauppauge. The two only recently went into business together and apparently Thorton was down on his luck, according to authorities.

Thornton, a family man himself, only recently moved into his posh new home in Nesconset, just a few blocks away from where DiMartino was raising his children.

"I'm surprised it's a very good neighborhood," said one neighbor.

Police wouldn't say how much money DiMartino had on him when he was murdered, but the plan was for Thronton, the topless dancer and her boyfriend to spit the money. All three are now behind bars, being held without bail. The suspects are due back in court on Friday.
