The deputy was dispatched to respond to a complaint about a man in a wheelchair at a St. Augustine Blockbusters store that was causing a scene.
When the deputy arrived at the store, he saw James Bertham Higgs, who had been issued a trespass warning last September to stay away from a St. Augustine Blockbuster store and the surrounding property which included a mall, records show.
But Higgs returned on Friday in a drunken state, according to an arrest affidavit from the St. John's Sheriff's Office.
When the deputy asked Higgs how much he had to drink that day, Higgs allegedly said "enough" before yelling loud obscenities.
According to the affidavit, Higgs had been yelling obscenities at everyone passing by, including children, which were loud enough to be heard across the parking lot.
Higgs then engaged in some very uncouth behavior: He took his junk out of his shorts and and peed at the front door of Blockbuster. A woman who was walking out of the front door at the time told deputies that she had to dodge his stream of urine, which almost hit her leg, the report stated.
Higgs was charged with trespassing after warning, indecent exposure, and disorderly intoxication.
Since Higg's wheelchair could not fit into the patrol car, a jail van was called to assist — even though Higgs is fully capable of walking and does not need the wheel chair.
The deputy wrote that Higgs "stood up from the chair and got into the back of my patrol vehicle to wait until the van arrived."More FloriDUH
