SACRAMENTO -- The undersecretary who oversees California parolees and adult and juvenile prisons was arrested on suspicion of drunk driving while in a state vehicle.

Scott Kernan, 47, was stopped by the California Highway Patrol for speeding just after 8 p.m. Sunday near Rancho Murieta in Sacramento County.

It was unclear whether Kernan was on state business when he was arrested.

Kernan's blood alcohol level exceeded the legal limit of .08, according to Officer Michael Bradley.

The CHP would not give Kernan's exact blood alcohol level.

Kernan has been put on personal leave awaiting discipline. The Office of the Inspector General has been notified, and will evaluate the circumstances and department policy to decide on the appropriate disciplinary action, which could range from a suspension to the loss of his job.

He is free on $1.480 bail, and will be arraigned July 16.

He has called Corrections Secretary Matthew Cate and "expressed remorse for his actions," according to corrections department spokesperson Seth Unger.

Kernan was appointed as one of three undersecretaries in the corrections department in November 2008.
