40-year-old Jason Luis Rivera was sentenced Friday and reportedly declined probation, instead opting for the jail term.
Rivera has been in custody since his arrest Sept. 8, when authorities say he was caught at Cyrus home carrying a pair of scissors.
Police had responded to a 911 trespassing call in the 11500 block of Amanda Drive in Studio City.
They found Rivera hiding in the bushes, and when he refused to cooperate with police, they use a non-lethal Taser gun on him.
As police searched him for additional weapons he told police, "I am a friend of Miley Cyrus. I am. She's my wife. Me and Miley have been friends for five years."
He reportedly told people at Cyrus' residence that he hoped to see the singer. She was not home at the time of the incident.
Rivera reportedly refused to leave the property, and lit candles while he was there before police arrived.
Rivera has no prior arrest record in California, but has a lengthy record in the state of Texas, including a trespassing charge.
