Conservative Texas laws are tearing one Houston family apart.
In 2004 William Flowers and his wife divorced. They both decided that the kids would stay with their mother.
Last March, Flowers was married again.
This time to Jim Evans in Connecticut, where the union is legal.
Flowers recently filed for custody of his kids here in Houston. A jury found that the kids should stay with their mom.
Then it gets complicated.
A Harris County judge issued a ruling that Flowers cannot leave his kids alone with any male that is not related by blood or adoption, including his partner Jim.
With no allegations of child abuse, endangerment or any complaints from the mother, Flowers and his partner believe the ruling was based on their homosexuality.
Flowers plans to appeal the ruling, but in the meantime they're urging other same sex couples to take a stand as well.
