    The Supreme Court's decision today to uphold Maryland's law allowing the collection of DNA samples from people arrested for serious crimes upholds the interests of justice, the Constitution and common sense. Concerns that the DNA samples could violate suspects' privacy were unfounded, the practice of taking the samples is less intrusive than other searches authorized under the Fourth Amendment, and the direct result of a ruling against the law would have been the possibility that a known rapist would be released onto the street.

    This week, the Supreme Court took another step — albeit a small one — toward restricting the severity of punishments courts can impose on juvenile offenders. In a 5-4 ruling, in which Justice Anthony Kennedy sided with the court's liberal wing, the justices ruled that juveniles convicted of murder may not be given mandatory sentences of life in prison without the possibility of parole. Writing for the majority, Justice Elena Kagan said "a judge or jury must have the opportunity to consider mitigating circumstances before imposing the harshest possible penalty" on minors under the age of 18.

    After three days of arguments before the U.S. Supreme Court, the case for the constitutionality of the Affordable Care Act, better known as "Obamacare," remains strong. Four members of the court, including the justice expected to be the key swing vote on the issue, asked tough questions of the government's lawyer about the requirement that individuals obtain health insurance that is at the heart of the case against the law. But the inaptness of the comparisons they used to call the individual mandate into question reveal the uniqueness of the health insurance market and the propriety of Congress' decision to regulate it in the way it did.
