    The Supreme Court's decision today to uphold Maryland's law allowing the collection of DNA samples from people arrested for serious crimes upholds the interests of justice, the Constitution and common sense. Concerns that the DNA samples could violate suspects' privacy were unfounded, the practice of taking the samples is less intrusive than other searches authorized under the Fourth Amendment, and the direct result of a ruling against the law would have been the possibility that a known rapist would be released onto the street.

    Nullification fever is spreading across the rural counties along the Mason-Dixon Line, with Cecil, Harford and Carroll counties passing resolutions in the last month declaring their view that Maryland's new gun control law is unconstitutional. Cecil's council kicked off the trend with a resolution stating its intent that no county resources be used to enforce the law. Harford took a more moderate tack, with its councilmen merely urging more study of the constitutionality of the law.

    If the tenor of their questions is any indication, the justices on the U.S. Supreme Court appeared evenly divided in the challenge to California's law banning gay marriage, with Justice Anthony Kennedy, predictably, in the middle. But rather than deciding which way to tip the scales, Justice Kennedy seemed to be looking for an escape hatch.     The Sun has published several commentaries, including one by Leonard Pitts Jr. ("Wrong about racism," March 3), discussing Justice Antonin Scalia's recent remark during oral arguments about the Voting Rights Act being a "racial entitlement." None squarely address the justice's claim that this subject has been written about. Out of curiosity, I did a bit of quick sleuthing and discovered that Mr. Scalia "wrote about it" himself using the term "racial entitlement" in a 1979 law review article written before he joined the Supreme Court.

    Robert Bork, who died Wednesday, occupies a peculiar position in the pantheon of American conservative heroes. Most conservatives celebrated Judge Bork as the champion of constitutional values who was denied his rightful position on the Supreme Court by liberals bent on warping constitutional language for partisan purposes. Constitutional conservatives for the past 25 years, however, have gone on precisely the sort of judicial crusade that Judge Bork condemned in his major writings. While Judge Bork and such contemporary justices as Antonin Scalia and Clarence Thomas share a superficial commitment to constitutional originalism, the originalism of the conservatives on the present Supreme Court bears little relationship to the originalism Mr. Bork pioneered during the 1970s and 1980s.
