"The case is closed," said Harvey Steinberg, Marshall's Denver-based attorney. "No charges will be filed."
New York City Police said Thursday they still are investigating but charges are unlikely.
The New York District Attorney has not filed any charges either.
The accuser, Christen Myles, 24, originally from Chino, Calif., filed a complaint with police. She alleged that at about 3:50 a.m. on March 11, Marshall punched her in the eye, causing her to be thrown to the ground and suffer a serious eye injury.
Myles, who was celebrating her birthday with friends and family that night, has said she wants Marshall held criminally accountable.
Marshall -- whom the Dolphins traded to the Bears in March -- has said he expects no disciplinary action from the NFL.
