Up until midday Thursday, the website, fox-obel.com, was still taking orders and collecting money, leaving customers unaware of the closure with charges for orders that went unfilled. Fox & Obel shut its doors for the last time on Oct. 6.
In addition to taking down the website, the AG’s office said the company has agreed to work to give refunds to customers who have already placed orders.
The AG’s effort followed a Tribune inquiry Wednesday about the website’s status. A customer reached out to the Tribune this week after being charged for an order that never arrived. The customer later was able to get the order’s charge removed by his bank.
The office added that it has not received any direct complaints from consumers about the site.
Fox & Obel closed after years of financial problems including missed rent payments and racking up hundreds of thousands of dollars in debt to its suppliers, utility companies and the Internal Revenue Service. The gourmet grocer also faced stiff competition from other highbrow downtown grocers and multiple failed health inspections.
The problems led the company to file for bankruptcy protection in September and, eventually, liquidation.
