  1. The case for Obamacare

    After three days of arguments before the U.S. Supreme Court, the case for the constitutionality of the Affordable Care Act, better known as "Obamacare," remains strong. Four members of the court, including the justice expected to be the key swing vote on the issue, asked tough questions of the government's lawyer about the requirement that individuals obtain health insurance that is at the heart of the case against the law. But the inaptness of the comparisons they used to call the individual mandate into question reveal the uniqueness of the health insurance market and the propriety of Congress' decision to regulate it in the way it did. And even as the justices questioned whether Congress overstepped its powers, they risked doing the same.

  17. Court strikes down heart of ground rent law: Now what?

    The Maryland Court of Appeals has found that a requirement that Maryland ground rent holders register their leases with the state or lose them is an illegal taking of property without just compensation. It’s too bad the courts never showed the same deference to the rights of those who lost their property under the old, wildly disproportionate legal remedy of “ejectment” that allowed ground rent holders to seize homes over small unpaid debts. It took action by the General Assembly in 2007, prompted by a series of Sun articles documenting abuses of the ground rent system, to remedy that injustice. Now the legislature will have to step in again to clean up the mess left by the court’s decision this week.

    The fight between billionaires and millionaires may be close to ending. That is how many Americans, including President Obama, viewed the labor dispute between the owners and players in the National Football League. There were other, legitimate debates between the two sides about safety and the care of retired players, but on the whole, the dispute was about money, lots of it, and that wasn't something that endeared either side to an American people muddling through the lingering aftermath of the Great Recession. The particulars of the deal, to the average person, are far less important than the deal getting done. Unemployment is high, wars are dragging on, Congress can't seem to get anything accomplished, and it's god-awful hot. On top of this, a lost season of football is something we do not need.
