Derry Township, Dauuphin County—The Derry Township School District says they wish it didn't have to go this far.
Filing a petition against the Milton S. Hershey Foundation, in a Dauphin County Court. Asking if the $ 36 million from the Foundation used for local venues are appropriate.
They say the school district is supposed to be the recipient of those funds, not, what they are calling entertainment.
Among those venues, the Hershey Gardens, Hershey Theatre, and Hershey Museum.
" That is money that could be used for example to be used for our technology program, including the one-to-one computer initiative, " says Derry Township Superintendent Dr. Richard Faidley
Derry Township says this is not about getting extra cash, but about maintaining Milton S. Hershey's legacy for education.
The Executive Director of the Milton S. Hershey Foundation Don Papson says, the trust is open to interpretation.
For example he says, these attractions are being used to educate thousands of students both in and around Derry Township.
" There are three clauses in the agreement, you`ll see there are three things that are and, or, and, or. That are up to interpretation," says Papson
This particular trust is one of three. Another is for the Milton S. Hershey School and the third, is for the Derry Township School District, which receives $ 1.8 million dollars annually.
" We feel as though it has been an abrupt change of heart from the school district and they`re entitled to their opinion," says Papson
