HACKENSACK, N.J. (WPIX)—A Florida man - accused of killing his son-in-law in New Jersey - is using his wide waistline as a defense in a murder case.
Edward Ates is accused of driving to the Garden State from his Fort Pierce home and shooting his 40-year-old son-in-law Paul Duncsak to death in 2006. Ates, who was 62-years-old at the time of the incident, claims he weighed 285 pounds and was in poor physical shape.
However, prosecutors claim Ates drove to Duncsak's home in Ramsey and shot the pharmaceutical executive. Authorities in St. Lucie County arrested Ates in 2007.
When the shooting occurred, Duncsak and Ates' daughter were apparently involved in a bitter custody dispute following their divorce.
