Former Anne Arundel County Superintendent Kevin Maxwell, who left earlier this month for a similar position in Prince George's County, received on Wednesday a $90,060 payout for unused leave time, Anne Arundel school officials said.
Maxwell formally resigned from Anne Arundel County schools in June to become chief executive officer of schools in Prince George's. Maxwell took over at Prince George's on Aug. 1; he will earn $290,000 annually. His contract in Anne Arundel paid him $257,000 a year.
Under provisions of his Anne Arundel schools contract, Maxwell earned 2.5 vacation days each month, with options to either carry over the leave to the subsequent year, covert it to additional compensation (calculated at a per diem rate of 1/260 of his annual salary) or convert it into a tax-sheltered annuity. In addition, Maxwell accumulated one day of sick leave per month, of which he could also carry over from year to year.
Maxwell's contract stipulated he could be paid for any unused vacation and sick leave upon resignation. The contract also required he give the school system a three-months notice of resignation and said he would be charged $10,000 for each month shy of three-month requirement. The contract said that no additional damages would be sought.
Anne Arundel schools spokesman Bob Mosier said on Friday that Maxwell was compensated $95,060 in vacation and sick leave, but he did not specify how many days of leave Maxwell had remaining on the deal.
Maxwell was penalized $20,000 of that amount for resigning within the three-months-notice requirement, but Prince George's County picked up $15,000 of the penalty as part of its agreement with Maxwell.
That left Maxwell to pay $5,000 of the penalty, giving him a compensation of $90,060.
Asked about Maxwell's payout, Anne Arundel school board president Teresa Milio Birge said, "Just as we followed the terms of his contract in assessing a penalty for him breaking the contract, we followed the terms of his contract for paying out his leave."
