The assistant city attorney for Annapolis has been charged with driving under the influence of alcohol after being pulled over in Millersville last month.

Gary Elson was pulled over by a police officer on northbound Route 3 near Interstate 97 shortly after midnight on April 24, according to a police report.

An Anne Arundel County police officer wrote that Elson's Hyndai Elantra crossed from the right lane into the left lane two times.

After field sobriety tests and a breath test at the Western District police station in Odenton, Elson was charged with driving while impaired by alcohol, driving while under the influence of alcohol, negligent driving and failure to drive a vehicle on the right half of the roadway. Results of the breath test were not listed in the police report, which was partially redacted.

Rhonda Wardlaw, a spokeswoman for the city, said Elson told city officials his blood-alcohol content was 0.05 percent. He has not been disciplined, Wardlaw said.

A trial is scheduled for August.

In Annapolis, the city attorney's office provides legal advice to the mayor, city council and city departments. Elson is the second-ranking official in the department behind acting city attorney Timothy Murnane.
