SALT LAKE CITY (AP)—
A psychiatrist says the man charged in the 2002 abduction of Elizabeth Smart has a narcissistic personality disorder but is competent and has been since his 2003 arrest. Dr. Noel Gardner evaluated Brian David Mitchell in 2003 as part of the state case against him. Gardner says he concluded then that Mitchell was clearly competent. In testimony at Mitchell's competency hearing in federal court on Thursday, Gardner said Mitchell does not have and never had a psychotic mental illness.
The hearing in U.S. District Court is scheduled to last through Dec. 11.
Prosecutors believe Mitchell is competent but Mitchell's defense attorneys say he is incompetent to stand trial on charges of kidnapping and unlawful transportation of a minor across state lines.
Smart was 14 when she was taken from her home at knifepoint in 2002.
