Hollywood delays vote on suing Granteed and two other retired cops over pension payouts

Commissioners postponed a vote Wednesday that might have paved the way for a lawsuit against the police pension board and three retired officers, including former Assistant Chief Louie Granteed.

City officials say the men — Granteed, Timothy Legacki and Frank McGarry — are getting paid more from their pension than they're due.

When commissioners asked for numbers, City Attorney Jeffrey Sheffel said he did not yet have them.

"I can't give you a dollars and cents number," he said. "We believe they are being paid in excess of what they should be."

Each retired officer should be getting paid 66 percent of their top salary. Instead, they are being paid 84.5 percent, Sheffel said.

Sheffel said a letter sent to the men's lawyer asking them to resolve the issue went unanswered.

Mayor Peter Bober warned that a precedent would be set if the city did not fight the case, but agreed to delay a decision until the commission had more details.

Commissioner Linda Sherwood said she would back a lawsuit despite being friends with one of the three men.

"If anyone thinks I am thrilled to vote yes, they are wrong," she said. "We have been through the worst hell ever in 2011 and 2012. No one is happy about doing this. But it has to be done."

Granteed, who retired from the Hollywood Police Department in June and lost a bid last year for Broward sheriff, denies being overpaid.

"We are not being overpaid anything," Granteed told the Sun Sentinel. "I don't think there is any merit to it."

All three officers are represented by Ronald Cohen, a union-hired attorney. Cohen said his clients learned of the city's plans after getting calls from a reporter.

Richard Brickman, a trustee with the Hollywood Police Officers' Retirement System, was perplexed by talk of a lawsuit.

"Once we get served the lawsuit, we'll understand more about it."
