Charges: Criminal drug conspiracy, armed violence and unlawful possession of a controlled substance Rodriguez, 41, of the 18-W-200 block of Knollwood Lane in Villa Park, arranged a drug deal that went bad in neighboring Aurora, resulting in the death of a Chicago man, police said. The deal, on Oct. 1, 2008, went sour after the buyer tried to take cocaine from the seller without paying, Aurora police said. According to police, a gun battle ensued at about 6:50 p.m. at a home in the 600 block of North Root Street in Aurora, and Hector Valtierrez, 28, of the 4100 block of South Rockwell in Chicago was killed. Juan Herrera, 28, of Prescott, Wis., was shot and wounded, but managed to hitch a ride to Provena Mercy Center Hospital, where he was later arrested, police said. Police allege Rodriguez was in the house at the time of the drug deal but fled the scene and drove to Chillicothe, more than 100 miles south of Aurora, where he was arrested in a hotel, police said. Herrera was charged with first-degree murder, armed violence and unlawful possession of a controlled substance with intent to deliver, police said. The owner of the home, Ernesto Acosta, 42, was charged with unlawful possession of cannabis with intent to deliver, according to authorities. Valtierrez's wife, Maria, 27, was charged with armed robbery, conspiracy to commit armed robbery and calculated criminal drug conspiracy.
