New trial is denied in 'Family Secrets'

A federal judge Thursday denied a new trial in the Family Secrets mob case, saying he didn't find that an alleged threat by one defendant against a prosecutor tainted jurors.

Frank Calabrese Sr., who was among the five defendants convicted of racketeering conspiracy last year, allegedly was seen by a juror mouthing: "You are a [expletive] dead man." Some defense lawyers argued that the alleged threat could have prejudiced the juror, who apparently discussed it in deliberations and then later reported it to prosecutors.U.S. District Judge James Zagel heard from the juror in a closed-door hearing in March and wrote in his ruling that jurors are permitted to observe defendants in court.
